1. Introduction and Acceptance of Terms

By registering an account with Metricade and continuing to use our services, you agree to these Terms and Conditions. Your ongoing usage signifies your acceptance and compliance with all guidelines, policies, and procedures set forth here. Metricade reserves the right to amend or update these Terms at its sole discretion. Updates will be effective upon posting on the Metricade website and will also be communicated to users via email.

2. Definitions

Account: A registered user profile necessary to access and use Metricade’s services.
Digital Goods: Digital content such as vouchers, game points, activation codes, and other similar digital products offered through Metricade.
Services: Any service provided by Metricade, including purchasing, reselling, and distribution of Digital Goods.

3. License to Use

Metricade grants you a revocable, personal, non-commercial, non-transferable license to access and use our services as per these Terms. Unauthorized reproduction, duplication, sale, or other commercial exploitation of our services or content is strictly prohibited.

4. User Registration and Account Security

You agree to provide accurate, complete information upon registration, including but not limited to full name, email address, phone number, and IP address. Maintaining the confidentiality of your account login details is solely your responsibility, and you must promptly notify Metricade of any unauthorized use.

5. Digital Goods and Payment Terms

Metricade offers various Digital Goods, which are non-refundable and non-transferable upon purchase, except in specific circumstances where Metricade may determine a refund or exchange is warranted. We do not resell gift cards or digital products for businesses or entities explicitly restricted by law or by agreements with our suppliers. Payments can be made through Stripe and PayPal in USD and AED only. Users are encouraged to verify all purchase details to avoid issues, as Metricade is not liable for erroneous transactions due to user error.

6. Prohibited Activities

Users agree not to engage in:

Any unauthorized resale, redistribution, or commercial use of Digital Goods.
Disruptive, offensive, or illegal activities within Metricade’s platform.
Uploading any harmful code or materials designed to disrupt our services.

7. Availability of Services

Metricade strives to offer continuous availability of services but cannot guarantee uninterrupted access due to maintenance, network disruptions, or technical issues beyond our control. Service modifications, interruptions, or termination can occur at Metricade’s discretion.

8. Limitation of Liability

Metricade is not liable for any indirect, incidental, or consequential damages, including lost profits, data loss, or any service interruptions beyond our control. Our liability, if any, is limited to the value of services provided in the three months preceding the event causing damage.

9. Intellectual Property Rights

All intellectual property associated with Metricade, including trademarks, content, and software, belongs solely to Metricade or its licensors. You may not reproduce, modify, or distribute any Metricade content or IP without explicit written permission.

10. User Data and Privacy

By using Metricade’s services, you consent to the collection and use of your data as outlined in our Privacy Policy. Metricade is committed to protecting your personal information and will only share it under legal requirements or as necessary for service provision.

11. Termination of Account

Metricade reserves the right to suspend or terminate accounts at our discretion, including for breaches of these Terms or any behavior harmful to Metricade’s platform, users, or brand. Upon termination, all rights to use the services will cease immediately.

12. Amendments to Terms

Metricade may modify these Terms at any time, and users will be notified through updates on the Metricade website and by email. Continued use of Metricade after such modifications constitutes acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

This Agreement and any disputes arising out of it shall be governed by and construed in accordance with the laws of the State of New Mexico, United States. Any legal claims will be exclusively resolved under the jurisdiction of the courts in New Mexico, United States.
